Legal advice in employment law



Q:I had 3 duis between 1988 and 1997. I've recently graduated with a bachelors in the medical field. Because I know i will be subjected to a background check, I have been disclosing the duis on my applications. Needless to say, I get very few call backs. As my last dui was 12 years ago, am I legally obligated to provide this information? Does a background check go this far back or is there some "statute of limitations" for providing this information? I "paid my debt" and now have a valid license but i feel i am still being punished over and over every time i have to grovel and explain past indiscretions to a possible employer.
A:Convictions remain on your record forever. They don't magically disappear after the passage of years. If you are asked if you've ever been convicted, and don't disclose them, it's a lie. Lies always come out. If you want an employer to trust you, be honest. From an employer's perspective, someone who is willing to lie about their background can't be trusted about anything else. You are also assuming that you aren't getting "call-backs" because of that information which, in today's market is a huge leap. It could well be that they are hiring people with greater experience that they can get for the same price as a new graduate they'd have to provide additional training for.

Give me help bout my DUI issue


Q : I have had a DUI two years ago and recently had a midomeaoner Domestic Violence charge. I recently had my fourth interview with a retail company that did a background check. I was told I was hired as long as there was nothing retail or felony related. I was called a week later and told due to my history I was not going to be hired. Is this due to state regulations? What can I expect in the future?

A : "I was told I was hired as long as there was nothing retail or felony related."

Well, I don't know what DUI convictions involve in your state -- even if they aren't a felony, that doesn't mean the person who told you this was not mistaken in their assumption that the conviction would have to be related to "retail" for you not to get the job.

As for the DV "charge", were you convicted?
"Is this due to state regulations?"

Doubtful, but how would we know from here? More likely that it's simply employer preference.
"What can I expect in the future?"

We cannot know the answer to this from here, but an employer is free to refuse to hire you based on conviction history. I'm afraid it's the price of breaking the law. You're free to talk with an attorney chance of getting the issues expunged.
